How the checker decides

The rule in plain words

A U.S. single-member LLC owned by a non-U.S. person is treated as a corporation for Form 5472 reporting. If money moved between the LLC and its owner during the year, it generally files Form 5472 with a pro forma Form 1120, even with no U.S. income.

U.S. corporations that are at least 25% foreign-owned file Form 5472 with their Form 1120. Multi-member LLCs are usually partnerships and file Form 1065 instead.

  • Due: April 15 for calendar-year companies.
  • Extension: to October 15 with Form 7004.
  • Filed by: fax or mail; it cannot be e-filed.
  • Penalty: $25,000 per form, per year.
  • Missed years: file them as soon as possible, ideally before the IRS contacts you.

FAQ

Checker questions

Is the Form 5472 checker accurate?

It applies the general IRS rules to your answers. Unusual situations, such as several owners, trusts or related companies, need a specialist review. We confirm everything before preparing any filing.

Will the IRS really charge $25,000?

The law sets the penalty at $25,000 for each late, incomplete or missing Form 5472. The calculator shows the maximum exposure, not a prediction of what the IRS will do in your case.

What should I do if I missed years?

Prepare and file the missing years as soon as possible. We prepare each year and, where it applies, a statement explaining the reason for the delay. Filing before the IRS contacts you usually gives you more options.

Do you store my answers?
